Directorate for Parliament liaison and legal assistance


1. General Information

               
Directorate for Parliament liaison and legal assistance is the specialized structure of the Ministry of National Defense, directly subordinated to the Secretary of State for Parliament liaison, public information and increasing personnel’s life quality, and it has the following main responsibilities:
- representing and defending the rights and interests of the Ministry of National Defence in relation with the public authorities, courts and other institutions of judicial activity as well as any Romanian or foreign person or legal entity;
- reviewing and endorsing, in terms of legality, of specific legal projects and documents submitted to the Minister of National Defence, involving the ministry patrimonial liability;
- coordinating the legislative drafting by the central or specialized structures of the Ministry of National Defense;
- promoting legislative drafts elaborated by the Ministry of Defense in front of public authorities and within the specialized committees of the Parliament;
- participating to drafting of regulations, orders, instructions as well as any other specific legislation;
- advising legislative drafts addressed to Ministry of National Defense elaborated by other public authorities, in cooperation with specialized structures of the Ministry of Defense with responsibilities in the field;
- providing legal assistance for the leadership of the ministry as well as for the central structures that don’t have a legal adviser employed or he cannot temporarily fulfill his duties;
- legally, managing of the measures taken at the level of the Ministry of National Defense concerning the prevention and combating terrorism;
- coordinating the harmonization process of legislative drafts provisions initiated by the Ministry of National Defense, with NATO's and EU's acquis;
- coordinating the legal assistance of relations with foreign armed forces;
- participation in specialized standing committees, which operate at the level of the central structures of the ministry, to ensure the legality of adopted or proposed measures;
- operative informing or through periodic reports addressed to the leadership of  Ministry of National Defense on the main issues on legal assistance as well as the appropriate measures to be taken;
- drafting the instructions regarding the legislative activity and legal assistance in the Ministry of National Defense;
- approving confirmation in the weapon "Military Justice"  for the officers in service appointed as Legal Adviser within the Ministry of National Defense;
- keeps record of the legal advisers within the Ministry of National Defense;
- consultation with representatives of associations and foundations operating in the defense field to establish joint programs or activities in the legislative and decision-making process;  
- keeps record of the associations and foundations addressing to the Ministry of National Defense and formulates responses to their requests;
- keeps record on the establishment of the associations, foundations and federations operating in the defense field;
- analyzes documents submitted by associations, foundations and federations activating in defense field, requiring the recognition of status as public utility, and formulates proposals for the Minister of National Defence.

3. Organization

To achieve the specific tasks, the Directorate for Parliament liaison and legal assistance is divided in three services, each service having sections, independent offices and compartments.
The structure of the Direction is the following:

- Service for Liaison with the Parliament, legislation and notifications;
- International law and legal relations Service;
- Litigation Service.
